A Court of the Western District of Texas held that a commercial auto liability policy issued to an employer, under which an employee truck driver qualified as an insured as a permissive user of a covered auto, did not provide coverage for a punitive damages award against the employee for his own gross negligence because such coverage would frustrate Texas public policy under the facts of the case at hand.
