A court of the Northern District of Texas denied an insurer's motion to strike an insured's testifying expert on the issues of causation and whether hail damage to a commercial structure was cosmetic or functional damage, holding that the expert is qualified and that any dispute regarding the publications upon which the expert relied go to the weight of the evidence.
