Court: Tx 4-San Antonio  12/12/2018  Appellate Court Affirms that Insured had Standing to Sue Insurer on UM/UIM Claim, which was Ripe Despite Lack of Judgment against Underinsured Driver

Court explained that the facts alleged by the insured, if true, were sufficient to support a claim against the insurer for breach of contract regarding underinsured benefits; thus, her claim was ripe. Further, the court explained that she had standing to sue the insurer as the insured under the policy personally aggrieved by the insurer's actions.
