The Court affirmed the district court summary judgment entered immediately after granting a bill of review, which included a denial of the insured's request for attorney's fees, because the insured acknowledged that he had not submitted evidence of his attorney's fees in response to the insurer's no evidence summary judgment motion and the attorney's fees affidavit attached to the petition for the bill of review was not in the record for the summary judgment.
