A court of the Northern District of Texas granted an ERISA plan beneficiary's motion for partial summary judgment and remanded the matter to the insurer's administrative appeal process, finding that the insurer's denial of disability benefits on administrative appeal was based on a medical judgment and that the insurer failed to follow proper administrative procedure under ERISA where the medical judgment was rendered by a nurse and not a physician.
