A court of the Eastern District of Texas adopted a magistrate's recommendation to deny remand and dismiss the non-diverse insurance agency defendant, finding that the insured's allegation that the agency represented that the insured "would be compensated for damage or loss caused by water" is not specific enough under Rule 9(b).
