Allstate Insurance Co. a/s/o Vasquez v. Barnet

Court: Tx 8-El Paso  10/14/2019  Appellate Court Dismisses Appeal for Lack of Jurisdiction based on Party's Failure to Adhere to Requirements Associated with its Motion to Reinstate

The trial court dismissed the plaintiff's case for want of prosecution, and the plaintiff's attempt to move to reinstate the case failed to include a certificate of service evidencing service on the defendant and, therefore, the motion was a nullity and the deadline to file an appeal of the court's dismissal passed before notice of an appeal was filed. Thus, appellate jurisdiction did not exist.
