Zurich American Insurance Co. v. Certain Underwriters at Lloyd’s London

Court: Tx 1-Houston  08/27/2020  Insurer Cannot Rely on Equity to Obtain Reimbursement from Other Insurers for Multi-Million Dollar Settlement

The court found that a lower court had erred by allocating a $27 million dollar settlement on a pro rata basis among the triggered insurers and held that, in order to obtain reimbursement, the paying insurer must prove its right to reimbursement on an invoice-by-invoice basis because of the different types of coverages provided by the triggered insurers.
