Court: WD Tx  12/03/2018  District Court Dismisses Class Action Claims Filed by Insureds for Failure to Allege Facts Sufficient to Satisfy Elements of Class Certification

Under FRCP 12(c), the court found that the pleadings had closed and the insureds had failed to assert any facts to support class certification in regard to their claims that the insurer violated the Texas Insurance Code in denying their UM/UIM benefits.
