University Baptist Church of Fort Worth v. Lexington Insurance Co.

Court: 5th Cir  09/10/2019  Fifth Circuit Affirms Judgment for Insurer in Dispute with Church over Code Upgrade Coverage and Claims Handling

The court agreed that the insurer did not violate the Texas Insurance Code or the DTPA when it questioned a roofer's repair estimate as being inadequate, which ultimately resulted in a higher repair cost that far exceeded the insured's code upgrade coverage.
