State Farm Lloyds v. Ladkin

Court: Tx 2-Ft Worth  02/06/2025  Court of Appeals Affirms Jury Award for Actual and Treble Damages, Reversing and Remanding for the Narrow Issue of Appellate Fees

In a dispute over amount of hail damage incurred by insured homeowners under homeowners' policy, the appellate court found the evidence sufficient to support the jury award of actual and treble damages and that the insurer failed to preserve its appeal of the trial court's exclusion of expert testimony on causation, but where insured conceded she lacked sufficient evidence to support the appellate fees award this sole issue was reversed and remanded for a new trial.
