Court: WD Tx  07/28/2020  Insurer Granted Motion for Summary Judgment on Duty to Defend but not Duty to Indemnify

Garage liability insurer was granted summary judgment on its duty to defend an insured tire shop based on application of the policy's "Exclusion – Designated Garage Operations" endorsement, which excluded coverage for bodily injury arising out of maintenance of tires fire years or older, where underlying petition alleged injury-causing tire was six years or older, but the court found the duty to indemnify survived summary judgment.
