Salinas v. State Farm Lloyds
After appraisal award was paid by insurer under homeowner's policy following storm damage claim, insurer sought summary judgment on insured's breach of contract and extra-contractual claims, but insured sought and was granted an abatement of insurer's motion pending a ruling by the Supreme Court of Texas on seven cases before it on the similar issue of whether an insured may maintain extra-contractual and TPPCA claims following payment of an appraisal award by insurer.
