A Magistrate of the Western District of Texas recommended that an insurer be granted summary judgment on an insured's Stowers claim because the insured settled the claim prior to judgment, rendering the Stowers claim unripe, and on the insured's Texas Insurance Code Section 541 claims because a bona fide coverage dispute between the insurer and insured precluded recovery.
