The court noted that, because the insured did not preserve error, seemingly based on the Supreme Court of Texas's first decision in USAA Texas Lloyds v. Menchaca, the fact that the Supreme Court later issued a revised opinion on rehearing was not pertinent, as the insured conceded that the appeallate court could not grant the relief the insured sought.
