Redrick v. State Farm Lloyds

Court: Tx 5-Dallas  07/18/2019  Appellate Court Finds that Insured Failed to Preserve Error in Trial Court Regarding Conflicting Jury Answers, Leaving the Court only the Ability to Affirm the Judgment

The court noted that, because the insured did not preserve error, seemingly based on the Supreme Court of Texas's first decision in USAA Texas Lloyds v. Menchaca, the fact that the Supreme Court later issued a revised opinion on rehearing was not pertinent, as the insured conceded that the appeallate court could not grant the relief the insured sought.
