The court found that no duty to defend existed because the "intellectual property" exclusion was very broadly worded and was not limited to (1) an actual determination of unauthorized access to confidential information, or (2) the conduct of only vice principals and executives. Because no duty to defend existed, no duty to indemnify existed either.
