Court: SD Tx  09/16/2020  Court Denies Cross-Motions for Summary Judgment in Appraisal Dispute

The court determined that the appraisal award by itself was insufficient to demonstrate a breach of contract but ruled that summary judgment was not appropriate because of the insured's representations of a potential motion to set aside the appraisal award.
