The Northern District of Texas granted a life insurer's motion for summary judgment that payment to the beneficiary of a life insurance policy based on misrepresentation by beneficiary that he was the only child of the deceased insured constituted unjust enrichment under doctrine of "money had and received," but denied insurer's summary judgment on damages for failure to meet its burden of proof of specific amount owed to each beneficiary.
