The Court found that the term "employee" in the Texas Anti-Indemnity Act should be given its common, ordinary meaning and its scope should not be determined by the definition of employee included in the Texas Workers Compensation Act meaning that additional insured coverage does not apply even if the injured party would have been considered a co-employee under the compensation act.
