A court of the Southern District of Texas denied an insurer's motion for summary judgment, commenting that the law regarding concurrent causation remains unclear as to burdens, but finding that even if the insured has a burden to segregate causes or damages under the doctrine, the record included both expert and lay witness evidence sufficient to create a fact issue on whether the insured had met this alleged burden to segregate.
