A court of the Northern District of Texas granted in part an insurer's motion for summary judgment related to a water damage dispute under a homeowners' policy, denying the motion as to breach of contract and the Prompt Payment of Claims Act where where lay witness testimony is sufficient to determine damages, but granting the motion as to the duty of good faith and fair dealing, DTPA, and Chapter 541 where the record did not show that the insurer's liability had become reasonably clear.
