The Court concluded that the trial court had properly granted summary judgment to the insurer on the insureds' claims for breach of contract, statutory bad faith and violation of the Prompt Payment of Claims Act because those claims were based on the insurer's breach of an alleged duty to pay an appraisal award upon demand and no such duty exists because under Texas law, any duty to pay is based on policy language; thus, an appraisal award cannot create or expand coverage.
