Kenyon v. Elephant Insurance Company

Court: Tx 4-San Antonio  04/24/2019  Insurer has No Duty to Tell an Insured to Move to a Safe Location Following a Car Accident

A court has found that an insurer who accepts a post-accident phone call has no duty to ask the insureds if they are in a safe location or tell them to move to a safe location because the insureds would typically be in a better position to assess the safety of their location than a claims representative who is not on the scene.
