In re Progressive Casualty Insurance Co.

Court: Tx 12-Tyler  10/14/2020  Court Abused Its Discretion by Refusing to Sever and Abate Bad Faith Claims

The court ruled that the trial court had erred when it refused to sever the insured's extracontractual claims from its breach of contract claim because the insurer had made a settlement offer and had further erred by not abating discovery on the bad faith claims because those claims might be mooted by the jury decision on the breach of contract claims.
