The Dallas Court of Appeals withdrew its earlier opinion and found that the trial court did not abuse its discretion when it allowed a deposition of the corporate representative to proceed nor did the trial court abuse its discretion by denying the insurer's special exceptions because a claimant is not required to plead breach of contract in order to recover extra-contractual damages.
