Court: 5th Cir  11/15/2024  Fifth Circuit Holds Homeowners Policy Did Not Provide Coverage Where Insured Did Not Reside on the Property at Policy's Inception Date

The Fifth Circuit Court of Appeals affirmed summary judgment granted in favor of homeowners insurer where policy provided coverage for "residence premises" at the location the insured resided "on the inception date of the policy period" because it was not disputed the insured did not reside on the property until well after inception and despite the fact that insured was residing on the property when the damage occurred.
