Hernandez v. Unum Group

Court: ND Tx  06/04/2020  Ex-Wife's Claim to Life Insurance Proceeds Granted as ERISA Preempts State Law

Ex-wife of deceased employee under ERISA life insurance plan was named as the sole beneficiary despite divorce and was granted summary judgment against deceased's parents, who sought life insurance benefits pursuant to Texas Family Code Sec. 9.301, which generally would void ex-wife's beneficiary status, because the court held that ERISA preempted application of the Texas Family Code.

life insurance policy, ERISA, ex-wife, former spouse, sole beneficiary, Texas Family Code Sec. 9.301, preemption, interpleader
