A court of the Northern District of Texas accepted a magistrate's recommendation to grant an insurer's motion for summary judgment in a homeowner's policy hail damage dispute, finding that although the record contained evidence that hail had damaged the insured property, the insured presented no evidence that the damage had occurred during the policy period.
