Great Lakes Insurance SE v. Horton Family Trust, LLC
A court of the Northern District of Texas granted a commercial property insurer's motion for summary judgment on all of an insured property owner's counterclaims, and struck the appointed umpire and appraisal award in favor of the insured, finding the insured failed to provide a sworn proof of loss and to comply with other requirements of the policy prior to invoking the appraisal process.
