The Fifth Circuit Court of Appeals reversed summary judgment granted in commercial umbrella liability insurer's favor against another umbrella liability insurer, finding that the district court correctly assumed that one policy applied primary to the other, but that summary judgment was granted in error because a fact issue existed as to allocation.
