Galindo v. Empower Managing General Agency, Inc.
After an auto liability insurer paid policy limits to settle claims of some but not all claimants, the remaining claimants brought Stowers and breach of contract claims against a managing general agent and an insurer, and the court granted in part the agent's motion for summary judgment, holding Stowers claims are only viable against insurers and not managing general agents. The court denied the agent's motion for summary judgment on the claimants' breach of contract claim for lack of evidence.
