Court: 5th Cir  08/31/2020  Fifth Circuit Affirms Summary Judgment for Insured on Dispute over Notice of Claim

The court found that the policy's notice of circumstances provision was discretionary for the insured and, in any event, AmWINS was the insurer's agent for purposes of notice of claims; thus, the insurer had notice of the claim against the insured.
