Court: 5th Cir  03/12/2021  Fifth Circuit Certifies Northfield Extrinsic Evidence Question to the Supreme Court of Texas

After a year in which the Supreme Court of Texas adopted the first formal exception to the "eight corners" rule, the Fifth Circuit has asked the Court to examine whether extrinsic evidence can be used to determine the duty to defend in a general liability dispute when the date of the damage is not alleged.
