Apollo Medflight, LLC v. BlueCross BlueShield of Texas

Court: ND Tx  10/04/2019  District Court Adopts, in Part, Magistrate Judge's Report and Recommendation, Dismisses Causes of Action against Insurer under the Texas Insurance Code

The court found that the Emergency Care Statutes in the Texas Insurance Code do not create a private cause of action against an insurer, and the insurer was not liable for alleged violations of Chapter 541.060 of the Texas Insurance Code that were premised on that same non-existent private cause of action.
