Court: ED Tx  02/07/2025  Fact Issues Regarding Whether an Insured Committed Arson Results in Partial Summary Judgment

A court of the Eastern District of Texas granted in part an insurer's motion for summary judgment, finding that although fact issues regarding whether the insured burned down his own house existed, such fact issues also demonstrate that the the insurer's liability was never reasonably clear and require dismissal of the insured's claims for Chapter 541 violations and breach of the duty of good faith and fair dealing.
