Court: Tx Sup  05/21/2021  Divided Court Holds Insurer Can Be Responsible for Insured's Attorneys' Fees in UIM Declaratory Judgment Action

The majority held that an insurer's liability for payment of underinsured motorists benefits can properly be determined in a declaratory judgment action and further that the trial court has the discretion to award attorneys' fees to the insured.
