The appellate court explained that the the insurer had demanded a jury trial and paid the jury fee, and therefore under the rules of civil procedure, the award of attorney's fees was a question of fact for the jury and under Rule 279 a party waives its right to attorney's fees when it fails to put on evidence of its fees and fails to request the trial court to submit a question on attorney's fees to the jury.
